These Terms of Service ("Terms") govern your use of the PracTest mobile application ("PracTest" or the "App") operated by PracTest LLC ("we," "our," or "us"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
PracTest is an exam preparation tool only. It is not a substitute for formal education, professional training, or qualified professional advice.
The content provided in PracTest — including all practice questions, exam simulations, rationales, and explanations — is designed solely to help you prepare for professional licensing examinations. It does not constitute and must not be relied upon as professional, legal, medical, financial, real estate, or any other form of licensed professional advice or guidance.
Passing a licensing examination requires meeting all requirements set by the relevant licensing authority in your jurisdiction. PracTest makes no representation that use of the App will result in a passing score, licensure, or qualification for any examination or profession.
Special notice for healthcare-related examinations: Content related to healthcare licensing examinations (including but not limited to nursing, medical, and allied health certifications) is for exam preparation purposes only. It is not clinical guidance and must never be used to inform patient care, medical decisions, or clinical practice. Always consult a licensed healthcare professional for medical advice.

You must be at least 18 years of age to use PracTest and to purchase a subscription. By using the App, you represent and warrant that you meet this requirement. PracTest is intended for individuals preparing for professional licensing examinations and is not designed for or directed at children. For information about how we handle data relating to minors, see our Privacy Policy.
You may use PracTest's free features without creating an account. An account (email address and password) is required to purchase a subscription.
You are responsible for maintaining the confidentiality of your account credentials. You agree not to share your account with any other person. Each subscription is for individual use only — sharing credentials to provide access to others who have not purchased a subscription is a violation of these Terms and grounds for account termination.
You agree to provide accurate information when creating an account and to keep it current. You are responsible for all activity that occurs under your account.
PracTest offers paid subscriptions that unlock full access to content for specific examinations. Subscriptions are offered on a per-exam basis.
Billing
Subscriptions are billed through the platform app store on your device — Apple App Store for iOS users, or Google Play Store for Android users. Payment is charged to your app store account at confirmation of purchase. Subscription fees and available billing intervals are displayed in the App prior to purchase.
Auto-Renewal
Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date. Your app store account will be charged for renewal within 24 hours prior to the end of the current period. The renewal price will be the same as the original subscription price unless you are notified otherwise.
Free Tier
PracTest provides limited free access to a subset of questions in each examination mode without a subscription. Free access content is subject to change at our discretion.
Refunds
All purchases are processed by Apple App Store or Google Play Store. PracTest does not issue refunds directly. All refund requests are subject to the refund policies of the applicable app store. To request a refund, contact Apple or Google through their respective support channels.
Cancellation
You may cancel your subscription at any time through your device's app store subscription management settings. Cancellation takes effect at the end of the current billing period. You will retain access to paid content until that date. PracTest does not process cancellations directly.
You agree to use PracTest only for its intended purpose of personal exam preparation. You agree not to:
All content in PracTest — including but not limited to exam questions, answer options, rationales, explanations, and the App itself — is owned by PracTest or its licensors and is protected by applicable intellectual property laws. Nothing in these Terms grants you any ownership right in PracTest content.
You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the App for personal, non-commercial exam preparation purposes only, subject to these Terms.
We make reasonable efforts to ensure that exam preparation content is accurate, current, and aligned with the subject matter of the relevant licensing examinations. However, licensing examination content, test blueprints, and passing standards are set by third-party examination authorities and are subject to change without notice.
PracTest does not warrant that its content reflects the most current examination specifications at any given time. You are responsible for verifying current examination requirements with the relevant licensing authority.
We reserve the right to suspend or terminate your account, without prior notice or liability, if we determine in our sole discretion that you have violated these Terms or that your use of the App poses a risk to the App, other users, or PracTest.

Upon termination, your right to access the App ceases immediately. Subscription fees already paid are not refundable upon termination for cause. If you believe your account was terminated in error, contact us at support@practest.app.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, PRACTEST DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.
We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant that the App will meet your specific requirements or that use of the App will result in a passing score on any examination.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, PRACTEST SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL PRACTEST'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE APP EXCEED THE AMOUNT YOU PAID TO PRACTEST IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such jurisdictions, the above limitations apply to the fullest extent permitted by law.
You agree to indemnify, defend, and hold harmless PracTest and its officers, agents, and representatives from and against any claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising out of or related to your use of the App, your violation of these Terms, or your violation of any third-party rights.
The App integrates with third-party services including Google Firebase, RevenueCat, and the applicable platform app store. Your use of those services is governed by their respective terms and policies. PracTest is not responsible for the practices or content of any third-party service.
We may update these Terms from time to time. When we do, we will update the "Last Updated" date at the top of this page. For material changes, we will provide notice within the App. Your continued use of PracTest after updated Terms are posted constitutes your acceptance of the revised Terms.
If you do not agree to the updated Terms, you must stop using the App and cancel any active subscriptions through your app store settings.
These Terms are governed by and construed in accordance with the laws of the State of New Jersey, United States, without regard to its conflict of law provisions.
Any dispute arising out of or relating to these Terms or your use of the App shall be resolved through binding individual arbitration under the rules of the American Arbitration Association, unless you opt out of arbitration by notifying us in writing at support@practest.app within 30 days of first agreeing to these Terms. Class action and class arbitration are waived — all disputes must be brought in an individual capacity.
Notwithstanding the above, either party may seek injunctive or other equitable relief in a court of competent jurisdiction in New Jersey to prevent irreparable harm.
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining Terms remain in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and PracTest regarding your use of the App and supersede all prior agreements and understandings.
